Confidential pricing dispute could reshape procurement transparency

A €75m public retrofit contract is at the centre of a legal challenge that could have major implications for procurement confidentiality. After losing the contract to Abtran, former provider KSN is appealing a High Court decision that refused access to Abtran’s significantly lower pricing structure—reportedly 30% cheaper than KSN’s.

The Sustainable Energy Authority of Ireland (SEAI), which awarded the contract, maintains the process was fair. But KSN argues the lack of pricing disclosure undermines transparency and sets a troubling precedent for public tendering.
