Industry NewsProcurement challenge stalls Dublin parking contract
Dublin City Council has applied to the Commercial Court to lift a suspension preventing the award of a €51.2 million parking enforcement contract, following a legal challenge brought under EU procurement regulations.
The contract covers a broad range of parking management services including vehicle clamping, relocation and removal operations, fine administration, operation of a payment centre and management of a vehicle pound. According to reporting on the proceedings, the contract had been awarded to Apcoa Parking Ireland Ltd following a competitive tender process involving four bidders.
Q-Park Ireland Ltd and Dublin Street Parking Services Ltd have challenged the outcome of the procurement exercise. Q-Park argues that aspects of the tender evaluation process contained unlawful and materially incorrect assessments across several areas, including operational management, financial management and implementation planning. Dublin City Council has rejected those claims.
Under EU procurement rules, once a legal challenge is initiated by an unsuccessful bidder, contract award procedures are automatically suspended until a court determines whether the standstill should remain in place or be lifted. Contracting authorities may apply to remove the suspension where delays create operational or financial consequences.
During proceedings, the council argued that maintaining the suspension could result in increased costs to the public purse, citing projected annual savings of between €500,000 and €1 million under the proposed arrangement. The council also raised concerns regarding mobilisation timelines linked to the future operation of the vehicle pound.
The Commercial Court admitted the matter to the fast-track commercial list and indicated that it should be heard before the end of the current legal term.
The case highlights how procurement challenge mechanisms continue to shape public contract delivery by balancing competition, transparency and service continuity across major public-sector procurements.
